These Terms of Service are available in English, Traditional Chinese, and Simplified Chinese. In case of conflicts, the Traditional Chinese version governs.

1. Acceptance of Terms

By accessing our website or using JSDesign's services, you agree to be bound by these Terms of Service and our Privacy Policy.

These terms constitute a legally binding agreement between you (the "Customer") and JSDesign Flooring & Interior Design ("JSDesign," "we," "us").

If you do not agree to these terms, please do not use our website or services.

You must be at least 18 years old or have parental/guardian consent to enter into this agreement.

These Terms of Service are governed by the laws of Taiwan (Republic of China).

2. Services Provided

JSDesign offers the following services:

2.1 Flooring Services

  • Free initial consultation (30-60 minutes)
  • Material selection guidance (hardwood, SPC, laminate, tile)
  • On-site measurement and assessment
  • Professional installation
  • Post-installation support and warranty service

Services are subject to availability and may vary based on location, materials, and project complexity.

3. Service Process and Obligations

3.1 Consultation Phase

Free initial consultation to discuss your needs, preferences, and budget.

Duration: 30-60 minutes

Obligation: No obligation to proceed after consultation.

3.2 Site Assessment

On-site visit for accurate measurement, subfloor condition assessment, and installation recommendations.

Duration: 1-2 hours

Note: Customer must provide site access and accurate property information.

3.3 Quotation and Agreement

Formal written quote provided within 3 business days after site assessment.

  • Quote valid for 30 days from issue date
  • 50% deposit required to confirm order and secure materials
  • Signed service agreement required before work begins

3.4 Installation

Professional installation by certified JSDesign installers.

  • Installation schedule agreed upon contract signing
  • Customer must ensure site access and utilities (electricity, water)
  • Estimated completion timeline provided (subject to project size)
  • Daily progress updates via phone or LINE

3.5 Completion and Verification

Final inspection and customer acceptance.

  • Customer verification within 3 days of completion
  • Final payment (50% balance) due upon verification
  • 1-year installation warranty begins upon final payment
  • Unused materials returned (full refund for unopened packages)

4. Pricing and Payment Terms

4.1 Pricing

  • All prices quoted in New Taiwan Dollars (NTD)
  • Quotes include materials and installation unless otherwise specified
  • Prices subject to change; locked for 30 days after quote issue
  • Additional charges may apply for: difficult access, subfloor repairs, furniture moving, extended service areas

4.2 Payment Schedule

  • Deposit: 50% upon contract signing (secures materials and installation slot)
  • Final Payment: 50% within 3 days of project completion and verification
  • Accepted Methods: Bank transfer, cash, LINE Pay (specify available methods)

Late Payment: Late payments (beyond 7 days) may incur a 2% monthly interest charge and suspension of warranty services until payment is received.

4.3 Price Adjustments

  • Material cost fluctuations (if materials not yet ordered)
  • Unforeseen site conditions (severe subfloor damage, moisture issues)
  • Customer-requested scope changes or upgrades
  • Additional work beyond original quote

Customer will be notified in writing of any price adjustments before proceeding. Customer approval required for changes exceeding 10% of original quote.

5. Cancellation and Refund Policy

5.1 Customer Cancellation

    Timing: Before Material Order (within 7 days of deposit)

    Refund: Full deposit refund minus 10% administrative fee (minimum NT$2,000)

    Timing: After Material Order (materials purchased/shipped)

    Refund: Deposit refund minus actual material costs and 20% administrative fee

    Timing: During Installation (work in progress)

    Refund: No deposit refund. Customer pays for completed work at contract rate.

Notice: All cancellations must be submitted in writing (email or LINE) to be valid.

5.2 JSDesign Cancellation

  • Force majeure (typhoons, earthquakes, pandemics, government orders)
  • Material unavailability from manufacturer (discontinued products)
  • Site conditions unsafe or unsuitable for installation
  • Customer breach of contract (non-payment, denied site access)

Refund: Full deposit refund if cancellation due to force majeure or material unavailability. Partial refund (minus completed work) if due to customer breach.

6. Warranties and Guarantees

6.1 Installation Warranty

Coverage: 1-year warranty on workmanship covering:

  • Flooring lifting, buckling, or separation
  • Improper installation techniques
  • Subfloor preparation defects (if performed by JSDesign)
  • Transition strip failures
  • Customer misuse or negligence
  • Water damage or flooding
  • Furniture scratches or dents
  • Normal wear and tear
  • Damage from pets or sharp objects
  • Color variations in natural wood (not defects)

6.2 Material Warranties

Flooring materials carry manufacturer warranties (varies by brand: 10-25 years typical).

Role: JSDesign assists with warranty claims but is not liable for manufacturer defects.

Registration: Customer responsible for registering products with manufacturers if required.

6.3 Warranty Limitations

  • Warranty limited to repair or replacement of defective work
  • JSDesign not liable for consequential damages (furniture, decorations, business interruption)
  • Total liability capped at contract value
  • Warranty void if customer uses unauthorized repair services
  • Customer must follow maintenance guidelines provided

7. Customer Responsibilities

Item: Site Preparation

Details: Remove all furniture and belongings from installation area (or pay for removal service: NT$3,000-8,000 depending on amount)

Item: Site Access

Details: Ensure installers can access work area during agreed hours. Provide parking if required.

Item: Utilities

Details: Provide access to electricity and water during installation.

Item: Accurate Information

Details: Disclose all known site conditions (previous water damage, subfloor issues, asbestos).

Item: Maintenance

Details: Follow care instructions provided. Use appropriate cleaning products. Avoid excessive moisture.

Item: Protection During Construction

Details: If other renovation work follows flooring installation, customer must protect floors (cover with cardboard/plastic).

8. Liability Limitations

8.1 Scope of Liability

  • JSDesign's total liability limited to the total contract value
  • Not liable for consequential, indirect, or incidental damages
  • Not liable for delays caused by: material shortages, weather, force majeure, customer-caused delays

8.2 Exclusions

  • Subfloor conditions not visible during site assessment
  • Hidden structural defects in building
  • Color/grain variations in natural wood products (inherent characteristic)
  • Damage from customer's contractors or pets after installation

8.3 Force Majeure

JSDesign not liable for delays or failure to perform due to:

  • Natural disasters (typhoons, earthquakes, floods)
  • Government actions or regulations
  • Labor strikes or material shortages
  • Pandemics or public health emergencies

9. Dispute Resolution

Step 1: Direct Negotiation

Contact your sales representative or project manager to resolve issues informally.

Timeline: Response within 3 business days

Step 2: Formal Complaint

Submit written complaint to jsdesigntaiwan@gmail.com with photos and detailed description.

Timeline: Investigation and response within 7 business days

Step 3: Mediation

If unresolved, both parties agree to attempt mediation through a neutral third party.

Cost: Mediation costs shared equally

Step 4: Legal Action

As a last resort, disputes resolved through Taiwan courts.

Venue: Taoyuan District Court (桃園地方法院)

Governing Law: Governed by laws of Taiwan (Republic of China)

Language: Legal proceedings conducted in Traditional Chinese

10. Changes to Terms of Service

JSDesign reserves the right to modify these Terms of Service at any time.

  • Changes posted on website with updated "Last Modified" date
  • Email notification for material changes (sent to customers with active contracts)
  • Continued use of services after changes constitutes acceptance
  • Changes do not affect existing signed contracts (governed by terms at time of signing).

    11. Miscellaneous Provisions

    Severability

    Description: If any provision is found invalid, remaining provisions remain in full force.

    Entire Agreement

    Description: These Terms, together with signed service contract and Privacy Policy, constitute the entire agreement.

    No Waiver

    Description: Failure to enforce any right does not constitute waiver of that right.

    Assignment

    Description: Customer may not assign contract without JSDesign's written consent. JSDesign may assign to qualified subcontractors.
